Barclays chairman quits after rate-rigging scandal

LONDON (Reuters) - Pressure mounted on Monday for Barclays Plc chief executive Bob Diamond to quit after Britain's third biggest bank sacrificed its chairman over an interest rate rigging scandal that has dealt "a devastating blow" to its reputation.

Chairman Marcus Agius, who said "the buck stops with me", is the first major scalp from a scandal that is likely to involve more banks and embarrass financial regulators.

But the departure of Agius did not take the heat off Diamond, who was running Barclays' investment banking arm when the interest rate manipulation took place.

"The buck in Barclays stops with Bob Diamond, and it is Bob Diamond who must accept responsibility," said John Mann, a Labour politician and a member of a panel of lawmakers who will grill Diamond on Wednesday, and Agius on Thursday.

"He (Diamond) must resign. He's got to go. There is no role for people like him if banking is to be trusted again in this country and if British banking is to restore its tarnished reputation in the world, which of course is of great importance to our economy," Mann said on Sky News.

Barclays has admitted that some of its traders tried to manipulate the London Interbank Offered Rate (Libor), which is used worldwide as a benchmark for prices on about $350 trillion of derivatives and other financial products.

Prime Minister David Cameron has called the scandal "extremely serious" and said management had "some big questions to answer". Authorities also ordered a review into the working of Libor, a key lending rate between banks.

"Last week's events - evidencing as they do unacceptable standards of behavior within the bank - have dealt a devastating blow to Barclays reputation," said Agius, 65.

"I am truly sorry that our customers, clients, employees and shareholders have been let down," he said.

Britain's Serious Fraud Office, which has been working with the Financial Services Authority (FSA), said it would decide within a month whether to press criminal charges.

The Barclays affair comes at a time when banks in Britain, - already under fire for their role in the financial crisis, are facing a new wave of public outrage.

A technology problem at RBS shut millions of customers out of their accounts last month, and evidence has emerged showing banks mis-sold financial products to thousands of small businesses.

FAR AND WIDE

Fined $453 million by U.S. and British authorities, Barclays is the first bank to settle in an investigation which is looking at more than a dozen other banks, including Citigroup, HSBC, UBS and RBS.

HSBC said that as a bank that contributes to setting the Libor interest rate it was providing information to authorities, but the FSA said it was not investigating the bank.

"Barclays has become the poster child for this because they have been the first to be assessed by the regulators," Euan Stirling of Standard Life Investments, a major investor which holds some 2 percent in Barclays, said on BBC radio.

"I think this is going to spread far and wide through the industry," Stirling said.

Smaller shareholders were robust in their demands for Diamond to take responsibility.

"I still think it is going to be hard for Bob Diamond to keep his job. I don't think he has built up enough shareholder goodwill in the past to be able to ride this one out," said a top-25 investor in the bank, who asked not to be named.

Barclays shares were up 3 percent at 09:17 a.m. EDT (1317 GMT), outperforming a 1.6 percent rise by the European bank index.

The exit of Agius was not seen as a big blow, analysts said, and a 17 percent crash in the past three trading days looked excessive in light of the hit the bank is likely to suffer.

CONVERSATION WITH THE BOE

Lawmakers this week are likely to quiz Agius and Diamond on what the Bank of England (BoE) and other regulators knew about the rate-rigging.

The hearings could prove embarrassing for the central bank, after sources told Reuters a conversation in October 2008 cited in documents released by U.S. authorities last week was between Diamond and BoE Deputy Governor Paul Tucker.

Some people at Barclays mistakenly believed they had been granted permission to submit artificially low rates for Libor after the conversation, the documents showed.

"It is nonsense to suggest that the Bank of England was aware of any impropriety in the setting of LIBOR," a BoE spokesman said. "If we had been aware of attempts to manipulate LIBOR we would have treated them very seriously."

Barclays has admitted it submitted artificially low estimates of its borrowing costs from late 2007 to May 2009 because it thought rivals were doing the same, and higher submissions would make it appear to be in trouble.

Barclays employees expressed their concern that Libor rates were being set too low to the British Bankers' Association - the UK banking lobby group that is also responsible for setting Libor - the Financial Services Authority, the BoE and the Federal Reserve Bank of New York between November 2007 and October 2008, a U.S. Department of Justice document said.

However, the employees did not provide "full and accurate information" to the authorities, the document said.

Barclays said it would launch an audit of its business practices, led by Michael Rake, its senior independent director, who will move up to deputy chairman.

Rake is seen as a strong candidate to become Barclays' next chairman - especially as he was not appointed to lead the search for Agius's successor - although he is already chairman of BT Group and easyJet, and may have to give up one or both of those.

The audit will undertake "a root and branch review of all of the past practices that have been revealed as flawed" and assess implications for its practices and culture. Diamond said its recommendations would be implemented in full.

Cambridge-educated Agius became chairman at the start of 2007 after more than 30 years as an investment banker and then chairman at Lazard. His wife Kate, a successful art dealer, comes from the Rothschild banking dynasty.

Wealth-X, the Singapore-headquartered research house which tracks the wealth of the world's richest people, estimates that Agius has a net worth of at least $35 million.

Agius also relinquished his position as chairman of the BBA, a role that is drawn from the senior ranks of one of the banks. The BBA said it would announce a successor in due course.

Saints linebacker Jonathan Vilma may have passed on the opportunity to prove his case for innocence in front of Commissioner Roger Goodell, but Vilma has unloaded in a 27-page, 180-paragraph civil complaint.

In Vilma?s new lawsuit against the NFL, a copy of which PFT has obtained, lawyer Peter Ginsberg details every alleged flaw in the case against Vilma, and to a certain extent the other players suspended for involvement in the Saints bounty program.

Heavy on factual contentions and light on legal theories, the lawsuit requests only two things:? (1) an order of ?specific performance? requiring Goodell to rule on the bounty appeals; and (2) a temporary restraining order and preliminary injunction preventing the league from implementing the suspension against Vilma if the suspension is upheld.

Along the way, Ginsberg makes the following claims on behalf of Vilma:

1.? Vilma was willing to meet with Goodell before the one-year suspension was imposed, but Vilma wanted to review in advance the materials gathered by the league ??which the NFL contend[ed] provided a basis to investigate Vilma.??? In exchange, ?Vilma offered to provide the NFL with complete ?detail[] [of] Vilma?s knowledge regarding [the Bounty Program] allegations.?? The league declined to do so, so Vilma declined to meet with Goodell.

2.? Goodell issued a ?gag order? on former Saints defensive coordinator Gregg Williams, preventing him from speaking to about about the investigation.

3.? Goodell made ?personal conclusions and described possible discipline? of players in a March 21 press release, even though he had not disciplined any players and planned to eventually serve as the supposedly impartial arbitrator.

Ginsberg also outlines the alleged flaws in the investigation, focusing on the follwing:

1.? The refusal to make certain witnesses available at the June 18 appeal hearing;

2.? The failure to deliver the exhibits to be introduced at the June 18 appeal hearing within three days (i.e., 72 hours) of the start of the hearing;

3.? The production of only 16 exhibits consisting of 182 pages from a file that supposedly includes 18,000 total documents and 50,000 total pages;

4.? The failure to produce any notes taken during witness interviews;

5.? The failure to produce original documents;

6.? The refusal to produce any potentially exculpatory evidence;

7.? The reliance on documents generated after the discipline were imposed;

8.? The alleged mischaracterization of the Anthony Hargrove declaration;

9.? The alleged mischaracterization of the Anthony Hargrove video from the 2009 NFC title game;

10.? The alleged mischaracterization of the September 2011 Mike Ornstein email message regarding an alleged $5,000 bounty on Packers quarterback Aaron Rodgers;

11.? The failure to include the September 2011 Mike Ornstein email message in the evidence to be introduced at the appeal hearing;

12.? The alleged mischaracterization of the 2009 email message from Ornstein to Williams, which Vilma claims reflects a commitment by Ornstein to contribute money to Williams? charitable organization (Ornstein allegedly explained this to Goodell, urging him to confirm it via the charity?s financial documents);

13.? Ornstein?s contradiction of the claim that he corroborated the allegation that Vilma placed a $10,000 bounty on Brett Favre prior to the 2009 NFC title game;

14.? The failure to make Ornstein available to testify at the June 18 appeal hearing or to produce notes of his interview(s);

15.? The strong denial by Saints interim coach Joe Vitt that Vilma placed a bounty on Favre or anyone else;

16.? The failure of the league to disclose that Williams never acknowledged to the NFL the existence of a bounty program;

17.? The alleged problems with the ledger information apparently leaked to Jason Cole of Yahoo! Sports on June 1, 2012, and the failure of the league to introduce the ledger as evidence at the June 18 appeal hearing;

18.? The reliance upon the statements of Mike Cerullo, a disgruntled former Saints employee;

19.? The problems with the typewritten version of handwritten notes regarding the bounty on Vikings quarterback Brett Favre, which Vilma contends were created ?well after? the 2009 NFC title game;

20.? The failure to issue a ruling on the appeal by Monday June 25, 2012, one full week after appeal hearings at which Vilma offered no substantive defense.

It?s unknown whether Vilma will get a chance to prove all of these allegations, and whether his ability to do so will result in his suspension being overturned.? It?s clear, however, that ?Phase Two? has begun ? and that it could last a lot longer than Phase One.

Sensational Malaysian submarine scandal resurfaces

A scandal linking Malaysia's leader, a young woman's murder and alleged kickbacks in a French submarine deal has resurfaced as a potential danger for the government as elections loom.

Even by the corruption-prone standards of Malaysia's long-ruling coalition, which since 2009 has been headed by Prime Minister Najib Razak, the Scorpene case is explosive.

It centres on allegations that French submarine maker DCNS paid commission of more than 114 million euros ($142 million) to a purported shell company linked to Abdul Razak Baginda, a former close associate of Najib.

Malaysia's opposition claims the payments were kickbacks to top officials involved in a $1.1 billion deal for Kuala Lumpur to buy two Scorpene-class attack submarines.

Abdul Razak's Mongolian mistress, who was said to have demanded a payoff for working as a language translator in the deal, was shot dead and her body blown up with plastic explosives near the capital in 2006.

But the extraordinary affair sank off the radar in 2008 when a Malaysian court cleared Abdul Razak of abetting the murder, sparking an outcry and opposition allegations of a huge cover-up.

Calls for further investigation were not pursued at the time.

Now, though, the affair is back in the headlines with a vengeance after French judges, acting on a complaint by opposition-leaning Malaysian rights group Suaram, launched a new probe in April.

Since then Malaysia's online media has been aflutter with talk of new "evidence" that Suaram and its lawyers say has been turned up by the judges.

They include an allegation that a classified Malaysian defence ministry report on the country's naval needs was sold to French defence giant Thales, which part-owns DCNS, possibly to help land the contract, according to Suaram's lawyer Joseph Breham.

Najib was defence minister in 2002 when the Scorpenes were ordered.

Malaysia's current defence minister, Ahmad Zahid Hamidi, told parliament on Tuesday that no confidential information was leaked or corruption involved in the submarine deal.

Breham has told AFP that as parties to the case, Suaram are allowed to view evidence in the ongoing investigation and quote from it, but not distribute hard copies. AFP is not able to verify the claims.

"We are quite overwhelmed at the developments in the case," said Suaram official Cynthia Gabriel. "If the French investigation had not opened, we would never have known about these things."

On Monday, news portal Asia Sentinel published 133 documents, which it said were obtained from the French inquiry and showed the deal "has resulted in a long tangle of blackmail, bribery, influence peddling, misuse of corporate assets and concealment, among other allegations".

AFP has no way of verifying the authenticity of the documents.

A DCNS spokesman said the company could not comment on the case, citing the ongoing judicial investigation.

The defence minister told parliament the deal was done through "direct negotiations in accordance with procurement procedures", without any commission being paid.

Najib himself has not commented publicly on Suaram's latest claims but has previously denied any link to the graft allegations, rejecting them in 2008 as a politically-motivated smear by the opposition.

Malaysian authorities have long refused calls for a wide-ranging inquiry.

Nurul Izzah Anwar, who is the daughter of opposition leader Anwar Ibrahim and who raised the issue in parliament, told AFP: "This concerns national security and is very serious.

"At the very least, Najib must explain to the electorate what happened."

The prime minister must call fresh elections by early next year, and will be seeking to reverse strong opposition gains in parliament at the last polls in 2008.

But he already faces corruption cases involving top officials, slowing economic growth, and questions over his pledges of change after police clashed with protesters at a rally for election reform attended by tens of thousands.

Suaram's allegations give the opposition a fresh weapon, said top Malaysian pollster Ibrahim Suffian.

"The case has new legs now. At minimum, it could embarrass Najib if it points to involvement by those close to him, and of course worse if we see direct involvement by Najib," he said.

Also looming is a late August court appeal by the two police officers convicted and sentenced to hang for the murder of Abdul Razak's mistress, Altantuya Shaariibuu.

Both of them are former police bodyguards of Najib and one, Sirul Azhar Umar, has previously said he was a scapegoat for higher-level culprits.

The French inquiry is likely to take years, and focus more on French politicians and business people than Malaysian officials.

But Breham told AFP that other new evidence seen by the plaintiffs points to a previously unknown company in Hong Kong called Terasasi receiving 36 million euros ($45 million) from Thales.

Records indicate Abdul Razak was listed as heading the company, said Breham, citing information he said was provided by the judges.
